These General Terms and Conditions of Sale are concluded between:
On the one hand, SneakArts, a simplified joint stock company with capital of 1,000.00 euros, registered in the Cannes Trade and Companies Register under number 911 561 272, whose registered office is located at 16 Avenue Léon Montier, 06590 Théoule-sur-Mer.., Hereinafter referred to as "SneakArts".and on the other hand, any natural person visiting or making a purchase on the sneakarts.com website hereinafter referred to as "the Customer".
ARTICLE 1: Purpose
The purpose of these General Terms and Conditions of Sale is to define the terms and conditions of sale in the context of the distance selling of products offered by SneakArts, from the website https://sneakarts.com.
The Customer declares that he/she has read and understood these Terms and Conditions of Sale before placing his/her order. Validation of the order therefore implies acceptance without restriction or reservation of these Terms and Conditions of Sale.
SneakArts reserves the right to modify, for legitimate reasons, at any time, these Terms and Conditions of Sale. In the event of modification, the general conditions of sale in force in the store on the date of purchase will apply.
ARTICLE 2: Products
SneakArts offers creative hobby products intended for the personalization, renovation, maintenance and protection of textile, leather and other surfaces.
SneakArts cannot be held responsible in the event of misuse of the products.
The products are exclusively intended for an adult audience.
The photographs, graphics and descriptions of the products offered for sale are indicative only and in no way binding on SneakArts.The Customer may obtain further information by e-mail.
ARTICLE 3 : Prices
Prices shown are in euros (€) and include all taxes, excluding shipping costs.
VAT is charged at the rate in effect at the time of purchase.
SneakArts reserves the right to modify the prices of its products at any time, but undertakes to apply the prices in force at the time of purchase by the Customer, subject to product availability at that date.
In the event of promotional offers, the prices indicated will be valid during the period of the offer and on the products covered by the offer.Only one promotional code may be applied at the time of order. Only non-discounted products are eligible for promotional offers. SneakArts reserves the right to refuse the order if several promotional codes are combined.
The order price will be exclusive of tax for countries outside the European Union. Customs duties and import taxes payable by the customer may apply.
ARTICLE 4 : Availability
The availability of products is indicated on the corresponding product sheet.
If a product is on pre-order, the Customer agrees to accept a delivery period of up to 30 working days pending availability. SneakArts will keep the Customer informed by e-mail upon request.
With regard to custom stencil orders, a design lead time is required (3 working days) which may vary depending on the complexity of the design requested.
ARTICLE 5: Ordering
Purchases made on sneakarts.com are reserved for consumers for their own use (or gifts) and not for resale.A sale is concluded only as from the confirmation of the order and validation of the transaction.The information provided by the customer at the time of the acceptance of an order engages this one. SneakArts cannot be held responsible for the impossibility of delivering the product if the recipient's details are incorrect.SneakArts prepares and dispatches orders within 1 to 10 working days.
ARTICLE 6: Payment
Payment of the customer's order may be made by:
- Credit card
- American Express
- Apple Pay
- Bank transfer from an issuing account in the customer's name
- PayPal.
The following credit cards are accepted: Visa, Eurocard/Mastercard.
Payment by credit card, Apple Pay and Amex is made via the Payplug module.
In the case of a request for payment by bank transfer. SneakArts will notify the customer by e-mail of the bank details of the account to which the transfer is to be made.
ARTICLE 7: Delivery
SneakArts offers worldwide delivery, excluding countries subject to restrictions. Products are delivered to the delivery address or relay point indicated when placing the order.
In the event of a return due to a wrong address or non-recovery of the parcel, the customer will be required to pay the delivery charges again.Once the order has been picked up by a carrier, SneakArts cannot be held responsible for any delivery problems, whether late, lost or stolen.Any order not shipped within 30 days of the order will be cancelled unless otherwise stipulated and announced in the sales offer.
Postage costs are automatically calculated according to the carrier, weight, size and destination of the package. They are charged to the customer and are indicated at the time of order confirmation. The customer receives a link by e-mail to track the order once it has been dispatched.
ARTICLE 8: Right of withdrawal - Modification - Cancellation
1 - Right of withdrawal
The right of withdrawal only concerns orders in mainland France.
The customer benefits from a legal right of withdrawal which he may exercise within 14 days of receipt of the goods, under the conditions set out in Articles L. 221-18 and L. 221-20 of the Consumer Code, if he meets the conditions set out in these provisions, without having to give reasons for his decision or pay penalties.
The right of withdrawal cannot be exercised for orders relating to the manufacture of goods made to the consumer's specifications or clearly personalized (cf: Custom paint or stencil).
Items must be returned in suitable packaging to the following address: 16 Avenue Léon Montier 06590 Théoule sur Mer.Unless the item delivered is faulty on receipt or does not correspond to the reference ordered, the return costs will be charged to the customer.
2 - Modification and Cancellation
Your order is put into production as soon as payment has been validated on our site. If you wish to modify or cancel your order, please notify us by e-mail or telephone as soon as possible. Once your order has been dispatched, we cannot modify or cancel it. The customer must then wait to take possession of it and then exercise his right of withdrawal.
ARTICLE 9: Guarantees
The customer must ensure that the items delivered correspond to his order. In the event that the items delivered do not correspond to the order or are damaged, the customer must inform SneakArts by e-mail and return the items in question under the conditions set out in article 8 of the General Terms and Conditions of Sale.
GARANTIE LEGALE DE CONFORMITE
Article L 217-4 du Code de la Consommation:
The seller is required to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when the latter was made his responsibility by the contract or was carried out under his responsibility.
Article L 217-5 of the French Consumer Code:
To conform to the contract, the good must:

Article L 217-12 of the French Consumer Code:
Action resulting from lack of conformity is barred by two years from delivery of the goods.
Article L 217-7 of the French Consumer Code:
Defects of conformity that appear within twenty-four months of delivery of the goods are presumed to have existed at the time of delivery unless proven otherwise. The seller may rebut this presumption if it is not compatible with the nature of the good or the claimed lack of conformity.
LAWFUL WARRANTY FOR HIDDEN DEFECTS
Article 1641 of the French Civil Code:
The seller is liable for any hidden defects in the item sold which render it unsuitable for its intended use or which impair this use to such an extent that the buyer would not have purchased it or would have paid a lower price for it had he known of them.Article 1648 paragraph 1 of the French Civil Code:
The action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect.
To benefit from the legal guarantee of conformity or the guarantee of hidden defects, the Customer must contact SneakArts by e-mail.

These terms and conditions apply for an indefinite period until they are updated by SneakArts.The date of update of the T&Cs is indicated on the first page of the document.
ARTICLE 13: Applicable law and litigation
These general conditions of sale are subject to French law. The language of this contract is French. In the event of a dispute, the parties agree, before taking any legal action, to seek an amicable solution via the following website https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR . Only French courts will have jurisdiction.
