GENERAL CONDITIONS OF SALE - VERSION 1.1 (20/12/2022)
The present General Terms and Conditions of Sale are concluded between :
On the one hand, SneakArts, a simplified joint stock company with a capital of 1,000.00 euros, registered in the Montpellier Trade and Companies Register under the number 911 561 272, whose registered office is located at 10 rue des Volontaires 34000 Montpellier, hereafter referred to as "SneakArts".
And on the other hand, any natural person visiting or making a purchase on the sneakarts.com website, hereafter referred to as "the Customer".
ARTICLE 1: Purpose
The present General Terms and Conditions of Sale aim to define the terms and conditions of sale within the framework of the remote sale of products offered by SneakArts, from the sneakarts.com website.
The Client declares to have read the present General Sales Conditions before placing his/her order. The validation of the order therefore implies acceptance without restriction or reservation of these General Sales Conditions.
SneakArts reserves the right to modify, for legitimate reasons, at any time, the present General Sales Conditions. In case of modification, the general sales conditions in force in the shop on the date of purchase will be applied.
ARTICLE 2: Products
SneakArts offers creative leisure products intended for the customisation, renovation, maintenance and protection of textile, leather and other surfaces.
SneakArts cannot be held responsible in the event of misuse of the products.
The products are exclusively intended for an adult audience.
The photographs, graphics and descriptions of the products offered for sale are only indicative and are not binding on SneakArts.
The Customer can obtain additional information by e-mail.
ARTICLE 3: Prices
The prices displayed are, by default, indicated in euros and include all taxes and are applicable in metropolitan France.
VAT is applied at the rate in force at the time of purchase.
SneakArts reserves the right to modify the prices of its products at any time but undertakes to apply the prices in force at the time of purchase by the Customer, subject to the availability of the products at that time.
In case of promotional offers, the prices indicated will be valid during the period of the offer and on the products covered by the offer.
Only one promotional code may be applied to the order. Only non-discounted products are eligible for a promotion. SneakArts reserves the right to refuse the order if several promotional codes are combined.
The price of the order will be exclusive of tax for countries outside the European Union. Customs fees and import taxes at the customer's expense may apply.
ARTICLE 4: Availability
The availability of products is indicated on the corresponding product sheet.
If a product is on pre-order, the Customer agrees to accept a delivery period of up to 30 working days while waiting for the availability of the product. SneakArts will keep the Customer informed by e-mail at his request.
Within the framework of the order of customised stencils, a design period is necessary (2 working days) which may vary according to the complexity of the design requested.
ARTICLE 5: Order
Purchases made on sneakarts.com are reserved for consumers for their own use (or gifts) and not for resale.
SneakArts prepares and ships orders within 1 to 10 business days.
ARTICLE 6 : Payment
The payment of the customer's order can be made by credit card, by Google Pay, by Apple Pay, by bank transfer from an issuing account in the customer's name, by PayPal.
The following credit cards are accepted: Visa, Eurocard/Mastercard.
Payment by credit card, by Google Pay, by Apple Pay, by PayPal is made via the "Prestashop Checkout" module.
In the case of a request for payment by bank transfer. SneakArts will send the customer the bank details of the account to which the transfer should be made by e-mail.
An order is validated once the payment is complete.
ARTICLE 7: Delivery
SneakArts offers delivery in the following countries: Metropolitan France, DOM, European Union, Switzerland, United Kingdom. For other destinations, the customer can request by email the exceptional implementation.
The products are delivered to the delivery address or to the relay point indicated when the order was placed. In the case of a return due to a wrong address or the non-recovery of the parcel, the customer will have to pay the delivery costs again.
Once the order has been picked up by a carrier, SneakArts cannot be held responsible for any problems in the delivery process, whether it be a delay, loss or theft.
In the event of a delay in shipment by the carrier, an email will be sent to you and a complaint will be made to the carrier. We also invite you to regularly consult your order tracking and to contact Customer Service for any questions or problems.
Any order not shipped within 30 days of the order will be cancelled unless otherwise stated and announced in the sales offer.
The delivery service provider is Boxtal.
For metropolitan France, home delivery is made via the carrier Colissimo - without signature. Indicative delivery time: 48 hours. Delivery to a relay point is made with the following carriers: Chronopost, Mondial Relay, Relais Colis. Indicative delivery time: 3 to 5 working days.
For the French overseas departments, Switzerland and the United Kingdom, home delivery is made by the Colissimo carrier.
For European Union countries, home delivery is made via the following carriers: Colissimo, Mondial Relay, Delivengo. Delivery time: 3 to 10 working days.
The customer receives an email with a link to track the order once it has been shipped.
ARTICLE 8: Right of withdrawal - Modification - Cancellation
1 - Right of withdrawal
The right of withdrawal only concerns orders in metropolitan France.
The customer benefits from a legal right of withdrawal that he/she can exercise within 14 days of receiving the goods, under the conditions set out in Articles L. 221-18 and L. 221-20 of the Consumer Code, if he/she meets the conditions set out in these provisions, without having to give reasons for his/her decision or pay penalties.
The right of withdrawal cannot be exercised for orders relating to the manufacture of goods made to the consumer's specifications or clearly personalised (cf: customised paint or stencils).
The items must be returned in suitable packaging to the following address: 10 rue des Volontaires 34000 Montpellier.
A return slip will be made available to the customer.
2 - Modification and Cancellation
Your order is put into production as soon as the payment is validated on our site. If you wish to modify or cancel your order, it is therefore imperative that you notify us by e-mail or telephone as soon as possible. Once your order has been shipped, we cannot modify or cancel it. The customer must then wait to take possession of it and then exercise his right of withdrawal.
ARTICLE 9: Guarantees
The customer must ensure that the items delivered correspond to the order. In the event that the items delivered do not conform to the order or are damaged, the customer must inform SneakArts by e-mail and return the items in question under the conditions set out in Article 8 of the General Terms and Conditions of Sale.
LEGAL GUARANTEE OF CONFORMITY
Article L 217-4 of the Consumer Code:
The seller is obliged to deliver a good in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.
Article L 217-5 of the Consumer Code:
To be in conformity with the contract, the goods must:
1. If it is fit for the purpose usually expected of similar goods and, where applicable: if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model; if it has the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling;
2. Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
Article L 217-12 of the Consumer Code:
The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.
Article L 217-7 of the Consumer Code:
Defects of conformity that appear within twenty-four months of delivery of the goods are presumed to have existed at the time of delivery unless proven otherwise. The seller may rebut this presumption if it is not compatible with the nature of the goods or the alleged lack of conformity.
LEGAL GUARANTEE AGAINST HIDDEN DEFECTS
Article 1641 of the Civil Code:
The seller is bound by the guarantee for hidden defects in the item sold which render it unfit for the purpose for which it was intended or which so diminish this use that the buyer would not have acquired it or would only have given a lower price for it if he had known about them.
Article 1648 paragraph 1 of the Civil Code:
The action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect.
To benefit from the legal guarantee of conformity or the guarantee of hidden defects, the Customer must contact SneakArts by e-mail.

ARTICLE 11: Protection of personal data
1 - Why do we collect your data?
The information and data concerning you are necessary for the management of your order and our commercial relations. It may be transmitted to companies that contribute to these relations such as those responsible for the execution of services and orders for their management, execution, processing and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations and to enable us to improve and personalise the services we offer you and the information we send you.
Depending on the choices you make when creating or viewing your account, you may receive offers from our company as indicated when creating your account.
If you do not wish to submit data about yourself when it is necessary for the performance of a contract or service you request, or when it is required by law, you will not be able to receive the product or service requested.
2 - Nature of the data collected
SneakArts collects the following data:
- Identity and contact information (surname, first name, postal address, date of birth, e-mail address, landline or mobile telephone number)
- Payment information
- Orders, invoices and their follow-up
- Customer journey on our online services
3 - Commercial e-mails
When creating an account, the customer can give his consent to the sending of commercial e-mails. The customer has the possibility to modify his preferences in his customer account.
4 - Data retention period
The duration of data retention complies with the recommendations of the CNIL and/or legal obligations.
- 3 years from the last contact for prospects
- 10 years following the end of the commercial relationship
Your data is then destroyed or anonymised.
5 - Data protection
SneakArts undertakes to implement security measures adapted to the degree of sensitivity of personal data to protect them against any malicious intrusion, loss, alteration or disclosure to unauthorised third parties.

6 - Your rights
In accordance with the French Data Protection Act and the European Regulations on the protection of personal data, the Customer has the right to access, rectify, oppose and delete personal data concerning him/her.

The Customer may also file a complaint with the Cnil.
ARTICLE 12: Duration
The present conditions apply for an indefinite period of time until they are updated by SneakArts.
The date of the update of the GTC is indicated on the first page of the document.
ARTICLE 13: Applicable law and litigation
The present general conditions of sale are subject to French law. The language of this contract is French. In the event of a dispute, the parties undertake, before any legal action is taken, to seek an amicable solution via the following website https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR . Only the French courts will have jurisdiction.
ARTICLE 14: Intellectual property
The "SneakArts" brand and the content of the site remain the property of the seller, who is the sole owner of the intellectual property rights on the content.
